By obtaining an Open Gym membership, personal training, and small group clients of PT Plus Coaches may access and make general use of the PT Plus facility (hereafter, “The Facility”) any time during operating hours (5 a.m. - 10 p.m.), 7 days a week. An Open Gym membership is right for you if you ever visit the Facility in either of the following capacities: 1. Blended: you engage in one-on-one, semi-private, or small group training sessions under the active guidance of your Coach at the Facility; but also engage in training sessions where your Coach a) is not providing active physical on-site guidance; and/or b) is not physically present at the Facility. This includes sessions in which your Coach is scheduled to arrive at the Facility after you or leave before you. 2. Remote: you engage in training sessions at the Facility - whether self-guided or among a group - where your Coach is not physically present. Access to the Facility without the active and physically present guidance of your Coach is not permitted without a PT Plus Open Gym membership. Open Gym Membership Provisions ● Member, listed below, is entering into an Open Gym Membership Agreement (hereafter, “Agreement”) with PT Plus (hereafter, “Owner”) directly to obtain access to the PT Plus training facility (hereafter, “the facility”). ● Membership shall be on a month-by-month basis beginning on the date designated below, terminating at the request of the Member or discretion of the Owner at any time, immediately and without penalty. ● Member will pay a membership fee (hereafter, “fee”) according to the following schedule for general access to the Facility during posted operating hours, 7 days a week except where informed in advance of private events. ● Single Member: $55.00 o Dual Member (two Members sharing legal address): $85.00 ● Payment of the membership fee will be made via auto-draft/EFT on the purchase date of every month via the debit/credit card or ACH information provided by the Member, below. ● If this automated payment is unsuccessful, the Owner will notify the Member. Payment in full is to be received no later than the 5th of the corresponding month. Failure to provide payment in full will result in forfeiture of access to the Facility. ● Open Gym membership is strictly non-transferable. The owner will provide the following amenities as a function of this agreement: ● General access to the Facility during normal operating hours (5 a.m. - 9 p.m.). ● Key/passcode to access Facility ● Facility liability agreement, to be read fully and completed by Members prior to their first Open Gym session. ● A climate-controlled training environment: o Heating to be maintained at 68F o A/C to be maintained at 74F ● General maintenance of Facility, including but not limited to maintenance of gym equipment and upholding a standard of consistent cleanliness for all gym common areas (gym floor, kitchenette, annex, parking lot, and basketball court area) and bathrooms ● Towel service ● Access to gym kitchenette, including refrigerator. ● Access to charging electronic devices (e.g. phones, tablets). ● Provide notice of and instruction on Opening and Closing Procedures. ● Access to choose and play House music when a Coach is not present, with consideration for and deference toward others using the Facility regarding music volume, genre, and content. Member will assume the following responsibilities as a function of this agreement: ● Reading, signing, and returning the Facility’s Liability Agreement before the beginning of their first Open Gym session. ● Making every reasonable effort to maintain the cleanliness, order, and safety of the Facility. This involves, but is not limited to, placing used towels in the laundry bag by the door, throwing away any plastic cups used during sessions, cleaning spills, putting away all used equipment (e.g. bikes, rowers, barbells, weights, kettlebells, bands, etc.) at the completion of their session, and generally keeping the Facility free of all material that may be considered offensive by Coaches, their clients, other Members or deemed by the Owner to be inappropriate for the environment. ● Familiarizing themselves with and closely following posted Opening and Closing procedures. ● Providing written notice of intent to terminate Membership no less than 5 business days in advance of their next scheduled auto draft/EFT, on or about the 1st of the following month. ● Any notice to stop an auto payment received less than 5 business days prior to the end of the month will be fulfilled on a “best efforts” basis. ● Ensuring the Owner has up-to-date payment information for monthly autopay, providing any changes in writing. ●Self-Canceling FAQ● ● Self-cancellation allows you to cancel your recurring products yourself by logging into the web version of Trainerize. When a product is self-canceled it will continue to the end of the current billing cycle but will not renew. This agreement is enforceable under the laws and regulations of the state of Ohio.
